Litigators of the Week: After Apple Was Hit With Two Prior 9-Digit Verdicts, a Defense Win in 4G Patent Case

Partners Joseph Mueller and Mark Selwyn were recognized as “Litigators of the Week” by The AmLaw Litigation Daily after securing a defense verdict for Apple with the jury finding no infringement of any asserted patent in a long-running 4G LTE patent dispute in the US District Court for the Eastern District of Texas.

Excerpt: “What’s the old saying about the third time? In August 2020, jurors in the US District Court for the Eastern District of Texas returned a $506 million damages verdict against Apple, finding infringement of five patents declared essential to the 4G LTE standard. After a retrial limited to damages, jurors returned a second verdict against Apple. The US Court of Appeals for the Federal Circuit later vacated the infringement finding and damages award. Back before Judge Rodney Gilstrap in Marshall, Texas, for a third trial, Apple prevailed. After five days of testimony, jurors found that Optis failed to prove infringement of any asserted patent.”
