WilmerHale Achieves Trial Victory for Reckitt Benckiser

A WilmerHale team, working closely with lawyers from Sheppard Mullin, secured a major victory for client Reckitt Benckiser following a jury trial in the District of New Jersey. The jury rejected claims brought by Absorption Pharmaceuticals, which sought $454 million in damages for alleged fraud and trade secret misappropriation. Absorption’s claims arose from Reckitt’s 2014-2015 evaluation of a potential transaction involving Absorption’s product Promescent and Reckitt’s 2016 launch of its product K-Y Duration.

The finding of no liability follows over five years of litigation, including multiple COVID-related delays, and testimony from 14 live witnesses during the four-week jury trial.

The WilmerHale team representing Reckitt Benckiser was led by Robert Gunther, Hallie Levin and Peter Neiman and included Jason Liss, Stephanie Lin, Alex Miller and Paul Vanderslice.
