The WilmerHale legal team that drafted BIO’s friend-of-the-court brief in Association for Molecular Pathology v. USPTO, commonly known as the Myriad Genetics case, will discuss the briefs and the oral argument in the case and, perhaps, the Federal Circuit’s decision. The progress of the case in the district court and Federal Circuit, the U.S. government’s evolving position, the future of the issue in the Supreme Court or Congress and related patent issues on the Supreme Court docket will be discussed.
Learning Objectives:
- Enable a spirited discussion of this and other high-profile patent cases affecting BIO’s members, including the Supreme Court’s 2010-2011 patent docket
- Educate the audience about recent developments in the Myriad case and BIO’s leadership role as an amicus
- Inform BIO’s membership of the importance of continued involvement with the issues raised, whether at the Supreme Court stage or in an effort to obtain legislative remedies
WilmerHale partners Seth Waxman and Mark Fleming, counsel Allen Nunnally and senior associate Thomas Saunders will be the moderators of this event.
