For companies that are not smaller reporting companies, the requirement to disclose material cybersecurity events under new Item 1.05 of Form 8-K takes effect today (December 18, 2023).  We have posted on the WilmerHale Privacy and Cybersecurity Law blog a few key points for companies to keep in mind as they think about their disclosure controls and procedures relating to this new requirement.
