Andrew J. Danford

Andrew Danford's practice focuses on intellectual property disputes at the trial and appellate levels. He has represented clients in patent disputes involving a broad range of technological fields, including pharmaceuticals, medical devices, smartphones, microprocessors, telecommunications networks and internet technologies. Mr. Danford also has experience involving design patents, trade dress and trade secrets.

Mr. Danford's practice encompasses all stages of litigation—from pre-suit investigations through discovery, summary judgment, trial and appeal. His recent trial experience includes several bench and jury trials in federal district courts in California, Texas and Wisconsin. He has also appeared in more than 10 appeals before the United States Court of Appeals for the Federal Circuit, as well as in several appeals before the United States Supreme Court. In addition, Mr. Danford has experience representing clients in inter partes review proceedings before the Patent Trial and Appeal Board.

While attending law school, Mr. Danford was a member of the Stanford Criminal Defense Clinic, where he drafted state and federal habeas petitions for prisoners sentenced under California's Three Strikes law. Following law school, Mr. Danford clerked for the Honorable Sandra L. Lynch of the US Court of Appeals for the First Circuit.

Mr. Danford is admitted to practice in the Commonwealth of Massachusetts and the State of New York, as well as before the United States District Court for the District of Massachusetts, the United States Court of Appeals for the First Circuit and the United States Court of Appeals for the Federal Circuit.

Professional Activities

Mr. Danford has delivered CLE presentations on recent developments in patent law at the Federal Circuit and Supreme Court, as well as on the topic of claim construction.

Mr. Danford is a member of the Boston Intellectual Property American Inn of Court.

    • Represented defendant in a 10-day jury trial relating to a microprocessor technology
    • Briefed several expedited Federal Circuit appeals relating to the availability of injunctive relief to a prevailing patentee against a competitor's infringing products
    • Argued evidentiary motions at the pretrial conference in a patent case in the Eastern District of Texas
    • Represented patentee in a 13-day jury trial involving various smartphone technologies
    • Represented patentee in a 5-day jury damages trial for the infringement of several design and utility patents by competitor's smartphones and tablets
    • Briefed Federal Circuit appeal involving validity of patent claiming a polymorphic form of an HIV drug
    • Briefed Federal Circuit appeal involving validity of patent claiming the active ingredient in a hepatitis B drug
    • Briefed Federal Circuit appeal involving inventorship dispute over wind turbine technology
    • Obtained covenant not to sue in declaratory judgment action brought by a networking equipment supplier, resulting in summary judgment of exhaustion for the supplier's customers
    • Briefed expedited Federal Circuit appeal from an order denying sealing of sensitive sales data and market research
    • Represented patentee in an inventorship dispute involving a COX-2 therapy
    • Represented patentee in multi-defendant Hatch-Waxman litigation in the District of Delaware related to proposed generic versions of a drug used to treat abnormal cholesterol levels
    • Briefed Federal Circuit appeal involving validity and enforceability of patent claiming a drug composition for the treatment of sleep disorders
