Strategic investments by state-sponsored companies, in particular from China, and calls for greater European strategic independence fueled by the pandemic have resulted in increased scrutiny of foreign investments in the EU, including those coming from the US. Consequently, regulatory reviews of transactions are no longer limited to traditional merger control, but parties are regularly also required to apply for a foreign direct investment (FDI) clearance.
