Denis Hurley represents companies and individuals in complex civil disputes in federal and state courts, as well as in arbitration. Denis has significant experience handling breach of contract and business tort disputes, bid protests, and cases arising under federal and state statutes, including the federal False Claims Act (FCA) and state false claims acts, the Electronic Fund Transfer Act (EFTA), the Freedom of Information Act (FOIA) and state law equivalents, and federal and state consumer protection and unfair competition laws. 

He has represented clients at every stage of litigation—from early case assessment and pleadings through fact and expert discovery, summary judgment, trial, and appeal—helping clients manage risk and position cases for favorable outcomes. Through each dispute, he works closely with clients to align litigation strategy with broader business and reputational objectives.

Denis’s current and past representations include:

  • Defending a major national insurance company against a state False Claims Act (FCA) suit related to abandoned property and escheatment
  • Representing a commercial real estate company as a plaintiff and cross-defendant in a landlord-tenant dispute, which resulted in a favorable settlement including recoupment of unpaid rent and unpaid operating costs
  • Serving as counsel for a large media and entertainment company in a licensing fee arbitration, securing an award of complete relief for unpaid royalties and damages
  • Defending a large national bank in a putative class action alleging breach of contract, Electronic Fund Transfer Act (EFTA) violations, and California unfair competition claims, which resulted in summary judgment in the bank’s favor
  • Representing a government contractor as an intervenor in a Government Accountability Office (GAO) bid protest, successfully defending the procurement and preserving the contract award for the client
  • Defending a large national bank in an enforcement action brought by the Consumer Financial Protection Bureau (CFPB) alleging unfair practices and violations of EFTA and Regulation E
  • Representing a financial advisory firm in a FINRA arbitration, which resulted in a favorable settlement and expungement of the FINRA regulatory record
  • Defending a major technology company in a putative class action asserting violations of New York state unfair business practices and false advertising statutes
  • Representing a media company in a New York state court breach of contract action involving construction defects, resulting in settlement on the eve of trial
  • Representing a large cell phone carrier as a plaintiff in multiple related federal and state court disputes involving spectrum licensing rights

Denis also maintains an active pro bono practice. He has briefed and argued multiple state criminal appeals, briefed veterans’ benefits appeals, and briefed FOIA challenges on behalf of a government ethics watchdog.

Prior to joining WilmerHale, Denis was an associate at a major Washington, DC–based litigation firm. He clerked for the Honorable Michael A. Chagares of the U.S. Court of Appeals for the Third Circuit and the Honorable Thomas C. Wheeler of the U.S. Court of Federal Claims.
