WilmerHale has advised on the most Foreign Corrupt Practices Act (FCPA) public settlements of any law firm in the industry in the past eight years and has been particularly successful in 2016, according to a recent Global Investigations Review Just Anti-Corruption report.
The firm has handled nine FCPA settlements since September 2008, including a flurry of settlements this summer. WilmerHale got a “huge boost” from four cases it helped resolve between June and August, involving LATAM, Johnson Controls, Analogic, and Key Energy Services, GIR reports. That's not including the resolution the firm achieved for PTC with the Department of Justice (DOJ) and the Securities and Exchange Commission (SEC) earlier this year.
In 2016, WilmerHale has been involved in a third (5-of-15) of all FCPA settlements with SEC, and this year the firm has been part of more than half (3-of-5) of the DOJ's FCPA settlements. Those numbers don't include three declinations the firm received from the DOJ for Johnson Controls, Key Energy and Cisco Systems as well as Cisco's declination from the SEC.
WilmerHale ranked third among law firms in the industry with the most declinations received from the DOJ since 2010, according to GIR data. Partners Erin Sloane and Jay Holtmeier were each a part of two of these declinations, the publication noted.
Partners Jay Holtmeier and Randall Lee and Senior Counsel Roger Witten were part of the team representing Cisco. The software company came under investigation by the SEC and DOJ in an overseas matter and made the declinations public this month, according to GIR.
Additionally, GIR highlighted that Holtmeier had been a part of four FCPA settlements since September 2008, which tied him for third among lawyers involved in the most FCPA settlements over this time period. The publication noted that Holtmeier is “one of the most experienced lawyers in recent FCPA enforcement history.”
WilmerHale was also one of only seven firms whose Washington DC offices recently received an “elite” ranking for its FCPA practice. Firmwide, GIR has named WilmerHale as a finalist for its Most Impressive Investigations Practice of the Year award.
