Please join us on Wednesday, November 18 for a webinar discussing the potentially far reaching and significant implications of the Supreme Court’s grant of certiorari in Arthrex. At issue in Arthrex is whether Patent Trial and Appeals Board (PTAB) Judges are principal officers and, therefore, require confirmation from the Senate under the Appointments Clause. The panel will provide an overview of:

  • Questions presented for Supreme Court review (e.g. Are PTAB Judges principal officers that require confirmation from the Senate?)
  • Potential outcomes and next steps for litigants and policy makers; and
  • Considerations and practice tips for filing, defending and appealing IPR petitions.

Panelists include WilmerHale Partners David Cavanaugh, chair of the firm's Post-Grant Proceedings Working Group and leading IPR practitioner; Thomas Saunders, recognized Supreme Court and appellate advocate; and Joshua Stern, co-chair of the firm's Post-Grant Proceedings Working Group and intellectual property litigator.
