As a result of recent regulatory changes, the Committee on Foreign Investment in the United States (CFIUS) has become an area of increasing focus for life sciences companies. Navigating the requirements—and debunking the myths—of CFIUS rules is routinely becoming part of financings, mergers and other significant transactions. Life sciences companies often have investors, acquirers and partners that raise potential CFIUS concerns, and few life sciences transactions of any nature will be able to avoid addressing CFIUS in some manner.
