WilmerHale Senior Associate Jonathan Lim spoke on the topic of "Jurisdictional Issues in Investment Treaty Arbitration." He addressed participants on nationality issues in investment treaty arbitration, “amount of compensation” clauses in first-generation Chinese BITs, as well as the territorial scope of application of Chinese treaties (in particular, whether they apply to Hong Kong and Macau). Mr. Lim was joined on the panel by Ms. Sun Huawei from Zhonglun Law Firm, who addressed specific jurisdictional issues that had arisen in Chinese-related treaty arbitrations. The session was moderated by Professor Julien Chaisse of the Chinese University of Hong Kong.
