Marissa Wenzel’s practice focuses on complex trial and appellate litigation, often against state and federal regulators. She has substantial experience litigating consumer protection claims, including class actions, for a wide range of clients. She has also defended financial-sector clients facing intricate and novel questions of payments law. 

Ms. Wenzel’s experience spans the full range of civil procedure, from complaint drafting through final appeal. In an advisory capacity, Ms. Wenzel provides strategic counsel to clients facing challenging legal and policy questions under media spotlight.

Ms. Wenzel also maintains an active pro bono practice. She led briefing in two successful immigration appeals to the US Court of Appeals for the Second Circuit, one of which she argued. She has also litigated pro bono cases in the areas of reproductive rights and racial justice. 

She clerked for the Honorable Lewis J. Liman of the US District Court for the Southern District of New York, the Honorable Stephen A. Higginson of the US Court of Appeals for the Fifth Circuit, and the Honorable Keith P. Ellison of the US District Court for the Southern District of Texas.

Ms. Wenzel has served as a member of the New York City Bar Association’s Children and the Law Committee. She currently serves as Secretary on the Board of Directors of Rock Recovery, a nonprofit organization based in Virginia.

    • Representing a technology company facing consumer protection claims brought by the FTC and state attorneys general. 
    • Representing a UK-based bank defending class action claims brought by investors. 
    • Representing a telecommunications company in litigation against a state attorney general.
    • Obtained dismissal of claims alleging unfair practices against a global bank. 
    • Achieved dismissal of data privacy claims against an advertising company.
    • Defeated certification of a proposed class of university students alleging breach of contract. 
    • Prevailed on a motion to dismiss class action claims concerning a major technology company’s wellness product.
    • Defeated certification of a proposed class of investors alleging market manipulation against a high-frequency trading firm. 
    • Led subpoena response for 30 non-parties in litigation brought in two federal district courts.
