A WilmerHale team led by William Lee, Don Steinberg, Michael Summersgill, and Calvin Walden achieved a significant victory for their clients, Eastman Kodak Company and Altek Corporation, when the Federal Court in the District of Delaware granted summary judgment in favor of Kodak in the patent lawsuit filed by Ampex Corporation.

Ampex filed patent infringement actions in the International Trade Commission (ITC) and the Federal Court in Delaware against Kodak in October 2004 in which it accused Kodak's digital cameras of infringing an Ampex patent. The Federal Court action was stayed pending the resolution of the ITC action. The ITC action was litigated for ten months. Shortly before trial, and after Kodak successfully moved to disqualify one of Ampex's expert witnesses, Ampex dropped its ITC complaint. The case was then litigated in the Federal Court in Delaware for over twelve months. In May 2006, WilmerHale filed a motion for summary judgment seeking a ruling that Kodak's cameras did not infringe Ampex's patent. The District Court agreed and, on November 1, 2006, granted summary judgment in Kodak's favor.
