WilmerHale Team Earns Shoutout in Litigation Daily’s “Litigators of the Week” Shout‑Out for Second Circuit Antitrust Victory

A WilmerHale team including partners Seth Waxman, David Gringer and Alan Schoenfeld, was recognized in AmLaw Litigation Daily’s May 9, 2026 “Litigator of the Week Runners‑Up and Shout‑Outs” column for securing a decisive Second Circuit victory on behalf of Ivy League universities in a high‑profile antitrust challenge. 

The US Court of Appeals for the Second Circuit affirmed the dismissal of a proposed class action alleging that Ivy League universities violated federal antitrust law by agreeing not to offer athletic scholarships. The plaintiffs argued that the policy unlawfully restrained competition over athletic‑based financial aid for elite student‑athletes. The appellate court agreed with the district court that the plaintiffs failed to plausibly plead a relevant market for either the sale of educational services or the purchase of athletic services. 

Waxman argued the appeal on behalf of the defendant universities. WilmerHale’s team represented the Trustees of the University of Pennsylvania.
