WilmerHale Achieves Jury Verdict for AGCO Corporation and Precision Planting LLC

On July 8, 2022, WilmerHale, alongside local counsel Morris Nichols, secured a victory for client AGCO Corporation and Precision Planting LLC following a jury trial in the District of Delaware.  

The case involved farming equipment and specifically, seed planting equipment that Deere & Company accused of infringing its patents. Deere accused AGCO and Precision Planting of willful infringement, and claimed that Precision Planting engineers deliberately copied a Deere patent application that had the same specification as the asserted patents. Deere sought lost profits and a running royalty, and also claimed that it was entitled to a permanent injunction.

After about two hours of deliberations, the jury found that AGCO and Precision did not infringe patents asserted by Deere.
