On July 8, 2022, WilmerHale, alongside local counsel Morris Nichols, secured a victory for client AGCO Corporation and Precision Planting LLC following a jury trial in the District of Delaware.
The case involved farming equipment and specifically, seed planting equipment that Deere & Company accused of infringing its patents. Deere accused AGCO and Precision Planting of willful infringement, and claimed that Precision Planting engineers deliberately copied a Deere patent application that had the same specification as the asserted patents. Deere sought lost profits and a running royalty, and also claimed that it was entitled to a permanent injunction.
After about two hours of deliberations, the jury found that AGCO and Precision did not infringe patents asserted by Deere.
Litigation Daily recognized the WilmerHale team as Litigator of the Week Runners-Up for this victory.
The WilmerHale team representing AGCO includes Michael Summersgill, Mindy Sooter, Mark Matuschak, Jordan Hirsch, Chip O’Neill, Arthur Coviello, Heath Brooks, Michaela Sewall, Harry Hanson, Myles McDonagh, Rachel Bier, Hannah Gelbort and Makenzi Herbst.
