WilmerHale Achieves Victory for Roche Diabetes Care Limited in UK

WilmerHale acted for Roche Diabetes Care Limited in its successful defense of a patent infringement action brought by Insulet Corporation before the High Court of England & Wales. Insulet had claimed that Roche’s Accu-Chek® Solo micropump infringed the claims of its patent and sought an injunction. The case came quickly to trial under the Court’s Shorter Trial Scheme and was heard in a three-day trial in May 2021. In a 127 page judgment, the Court held Insulet’s patent to be invalid and not infringed by Roche’s Accu-Chek® Solo micropump. The Court also denied Insulet permission to appeal the judgment and awarded costs to Roche. The team advising Roche was led by Partners Matthew Shade and Anthony Trenton with Associate Delicia Clarke and Senior Paralegal Kelly Burrowes.
