On September 17, 2020, WilmerHale’s International Arbitration Group and the Dispute Resolution Group at Khaitan & Co hosted a webinar on “Managing Cost and Time in International Arbitration—Effective Tools and Strategies.” 

The exclusive event for in-house counsel focused on procedural mechanisms and litigation strategies available to parties in India-related arbitrations to conduct their proceedings efficiently and expeditiously. The event focused on three aspects of the arbitral process:

  • Drafting arbitration agreements, including the determination of an appropriate arbitral seat and the considerations in choosing India as a seat, contractual time limits to render awards, provisions on cost allocation and the choice between institutional and ad hoc arbitration 
  • Procedural mechanisms to streamline proceedings, including the effective use of bifurcation, expedited arbitration, early determination and emergency arbitration procedures
  • The use of technology and remote hearings, particularly in light of recent developments following the outbreak of the Covid-19 pandemic  

The sessions focused on practical insights from the experiences of the members of the panel, which included Partners Gary Born and Steven Finizio, and Khaitan & Co Partners Sanjeev Kapoor and Nandini Khaitan. The discussions were moderated by Senior Associate Dharshini Prasad and Khaitan & Co Partner Kingshuk Banerjee.
