Please join attorneys involved in both sides of the Heimeshoff case for a discussion of its background and impact. Topics to be addressed will include a summary of the background and decision in the Heimeshoff case, the application of statutes of limitations under state law, and the types of contractual statutes of limitations that a plan may be able to adopt. The panel will also discuss the consideration of whether certain drafting alternatives that are permissible under Heimeshoff may or may not ultimately be desirable from a plan-design perspective, and of the possible application of Heimeshoff in the context of retirement plans.
