Cooperation Between Public Enforcers and Private Plaintiffs

Please join us for the upcoming American Bar Association (ABA) teleconference on "Cooperation Between Public Enforcers and Private Plaintiffs in the US and Europe," sponsored by the ABA Civil Redress Task Force. The concept of civil antitrust plaintiffs as “private attorneys general” is well established in the United States, but even their cooperation between the US antitrust authorities and the private plaintiffs’ bar has been sporadic, ad hoc and uneven. The panel of competition law experts will report on the current state of public and private cooperation in the US and will discuss whether more or less cooperation is appropriate and desirable in light of the legal and policy issues, such cooperation raises. The panel will also report on the state of public and private cooperation in Europe, and explore how such cooperation might factor into the European Commission’s and national competition authorities’ development of their own approaches to civil redress.
