Navigating Privilege Disputes in International Arbitration: WilmerHale Hosts Roundtable on the IBA’s Forthcoming Guidelines on Privilege

Navigating Privilege Disputes in International Arbitration: WilmerHale Hosts Roundtable on the IBA’s Forthcoming Guidelines on Privilege

London, UK
Signature Event

On 3 April 2025, WilmerHale’s London office hosted an International Bar Association (IBA) Roundtable that brought together leading counsel, arbitrators, and in-house lawyers to discuss the forthcoming IBA Guidelines on Privilege and Attorney Secrecy in International Arbitration. Special Counsel Dr. Sarah Ganz and Counsel Michael Howe participated in the Roundtable.

The IBA Guidelines aim to be the first widely-adopted international legal instrument to provide uniform rules for disputes over privilege in international arbitration and for determining the applicable law to such disputes. A draft of the Guidelines is intended to be available for public comment in late 2025, with the final version to be published after incorporating feedback received during the public comment process. WilmerHale Partner Franz Schwarz is a member of the IBA Task Force drafting the Guidelines, and Senior Associate Russell Childree is Secretary to the IBA Committee overseeing the drafting process.

For more information on the implications of these forthcoming Guidelines on international disputes, and for any questions on issues of privilege or attorney secrecy in international arbitration, please contact a member of the WilmerHale International Arbitration team.
