The New Antitrust Damages Directive has been heralded as an improved legal framework promising greater efficiencies in antitrust damages compensation and, as a result, a probable spike in the number of antitrust damages actions all across the EU. But, as the 28 member states work toward a December 27th transposition deadline, European organizations are also considering the impact of the Directive on their businesses and the potential risks—especially for current and future defendants—that may accompany the new rules.
