DIS Autumn Conference 2022: Disputes in an Age of Uncertainty - Managing the Energy Transition

The theme for this year’s DIS Autumn Conference 2022 is "Disputes in an Age of Uncertainty - Managing the Energy Transition." The conference will examine the many issues associated with the inherent uncertainty faced by energy companies due to a combination of energy transition, the war in Ukraine and the pandemic. These questions are particularly relevant for Germany, which so far wanted to rely on Russian gas to soften the transition to renewable energies.

Panels comprising both German and international practitioners will discuss different facets of the topic of uncertainty, all relevant to the resolution of energy disputes by arbitration. After a keynote speech by Professor Dr. Wolkewitz, General Counsel of Wintershall, panels composed of national and international practitioners, including WilmerHale Special Counsel Professor Dr. Maxi Scherer, will discuss how uncertainty can be measured, assessed and covered by contractual clauses; how uncertainty is to be taken into account in damage calculation; which best practices exist to efficiently manage arbitrations involving the energy transition; whether document production or other techniques are necessary to overcome uncertainty; and whether state courts are well suited to settle upcoming energy transition disputes, or whether there should be an alternative?
