WilmerHale Achieves Victory for Roche Diabetes Care Limited in UK
WilmerHale acted for Roche Diabetes Care Limited in its successful defense of a patent infringement action brought by Insulet Corporation before the High Court of England & Wales. Insulet had claimed that Roche’s Accu-Chek® Solo micropump infringed the claims of its patent and sought an injunction. The case came quickly to trial under the Court’s Shorter Trial Scheme and was heard in a three-day trial in May 2021. In a 127 page judgment, the Court held Insulet’s patent to be invalid and not infringed by Roche’s Accu-Chek® Solo micropump. The Court also denied Insulet permission to appeal the judgment and awarded costs to Roche. The team advising Roche was led by Partners
