Earlier this month, the European Commission published enforcement guidance that it will follow when applying Article 82 to exclusionary conduct by dominant companies. The much-anticipated announcement is pivotal for all firms that are or potentially could be the target of complaints. Under the guidance, the Commission reiterated that Article 82 should protect competition and consumers, instead of individual competitors. In doing so, the guidance established a number of general and specific principles to help dominant businesses assess whether their commercial arrangements are likely to be of interest to the Commission.
