Join WilmerHale Partners Derek Gosma and Rhonda Schmidtlein for a practical discussion on how companies named as respondents in International Trade Commission (ITC) Section 337 investigations can quickly assess risk, preserve options and build an effective litigation strategy.

Once a complaint is filed, respondents face an accelerated schedule, fast-moving discovery and the prospect of exclusionary relief that can disrupt imports and operations. This webinar will cover the key early decisions respondents face—how to prepare before suit, mobilize once a complaint is filed and align ITC strategy with parallel proceedings and business considerations.

Our panel will cover:

  • Steps to take before a complaint is filed to preserve evidence, assess supply chains and identify key defenses;
  • How to respond quickly once named as a respondent, coordinating internal teams, outside counsel and business stakeholders;
  • Practical considerations for the accelerated pace of ITC discovery, expert work and hearing preparation, including domestic industry, importation, remedy and public interest issues;
  • How to coordinate ITC strategy with parallel district court, PTAB, customs and business considerations, along with settlement leverage and business continuity; and
  • Recent developments at the Commission, including the swearing in of new ITC Commissioners and potential implications for Section 337 practice.

Participants will have the opportunity to submit questions online during the webinar. This program is being planned with the intention to offer CLE credit for attendees who join the live presentation.
