Georgetown Law's ITU is a premier continuing legal education program for the trade and customs bar and provides an annual forecast on legal and policy developments, which may feature trade remedies and customs law, trade policy, developments in disputes and trade negotiations, and sanctions and export controls. On Friday, March 14, Counsel Stephanie Hartmann participated in one of the sessions titled “Session B: Hot Topics at Commerce.” In this session, the speakers discussed significant developments at the Commerce Department, including recent litigation from the Court of International Trade and the Court of Appeals for the Federal Circuit, focusing on antidumping and countervailing duty (AD/CVD) proceedings.

Key topics covered included:

  • transnational subsidies;
  • the Commerce Department's adverse facts available policy; 
  • the reintroduction of “zeroing;” and 
  • anticipated changes to AD/CVD regulations and procedures under the new administration.
