
Allison Bingxue Que
Counsel
Allison Bingxue Que is a member of the Firm’s Commercial Litigation Group. Resident in the firm’s Palo Alto office, Ms. Que regularly practices in the Northern District of California and has advised clients from a wide range of industries, including various Bay Area-based global technology companies for a broad range of issues including consumer protection, unfair competition, cybersecurity and data security, online contract enforcement, online speech and First Amendment, and trade secret misappropriation. Ms. Que has experience with all aspects of trial-level litigation.
As a Mandarin speaker who has obtained law degrees and worked in both the United States and China, Ms. Que has also leveraged her unique intercultural background to counsel Chinese companies facing litigation in the United States.
Prior to joining WilmerHale, Ms. Que was an associate at a global law firm and clerked for the Honorable Eva M. Guzman of the Supreme Court of Texas. While in law school, Ms. Que externed for National Employment Law Project and participated in the Entrepreneurship and Community Development Clinic and the Supreme Court Clinic.
Experience

- Successfully defended an automobile manufacturer against false advertisement claims under New York General Business Law and obtained full dismissal, which was then affirmed by the Second Circuit;
- Successfully defended a Chinese social media conglomerate and its senior executives and secured full dismissal of a lawsuit brought by a Dutch company involving Racketeer Influenced and Corrupt Organizations Act (RICO) claim and trade secret claim in the Northern District of California;
- Secured dismissal of a defamation case against a social media company based on California’s anti-Strategic Litigation Against Public Participation Act (anti-SLAPP) statute;
- Successfully defended a consumer electronics company against claims brought by a user allegedly targeted by a sophisticated spyware company;
- Won summary judgment on behalf of a social media company against an Israeli company for breach of terms of use;
- Represented an online financial services provider in a consumer class action arising from a data security incident.
