Fiscal Year 2007 Employment-Based Visa Numbers Exhausted

The State Department today issued a new July Visa Bulletin, reversing its previously issued July Visa Bulletin, which had announced that visas would be available for the month of July for all employment-based immigrant preferences. The new Visa Bulletin states that no further authorizations will be made available in response to requests for employment-based preference categories for Fiscal Year 2007. Employment preference numbers will once again become available beginning October 1, 2007.

Foreign nationals who were preparing to file their applications under the prior July Visa Bulletin now will need to wait until the new visa numbers become available in October 2007, the beginning of fiscal year 2008, before filing for Adjustment of Status. The availability of employment-based immigrant visas for October 1, 2007, will be published by the State Department in mid-September 2007 in its October Visa Bulletin.
