The Investment Lawyer has published its September issue (Vol. 27, No. 9), with WilmerHale lawyers contributing an article titled, “Regulatory Monitor: SEC Update.” The piece examines the US Supreme Court’s decision in Liu v. SEC, which upholds the Securities and Exchange Commission’s power to obtain disgorgement in federal court cases, as long as the disgorgement does not exceed a wrongdoer’s “net profits and is awarded for victims.”
