During a recent panel at the Bipartisan Policy Center in Washington, WilmerHale’s Petal P. Walker discussed the need for a clear pathway for innovative individuals and entities to fully maximize the potential of cryptocurrency without being incumbered by the lack of guidance regarding the regulation of the cryptocurrency. Depending on whether there is an established network, she said, cryptocurrency may be a security or a commodity. “This paradigm is preventing potentially powerful innovative methods of engaging and ecosystems from coming into fruition because businesses can’t just start a network.”
