WilmerHale lawyers Martin Seyfarth, Naboth van den Broek and Matthias Wissmann will discuss the planned carbon border adjustment mechanism (CBAM) as part of the EU Green Deal. The CBAM may have tremendous effects on international trading of goods and may result in significant competitive burdens to non-EU corporations importing into the EU. We will discuss the status of the CBAM, political and related policy challenges, and, of course, the potential issues a CBAM raises under World Trade Organization (WTO) and other trade rules:
- Background on Europe’s efforts to go climate-neutral by 2050 and the current CBAM discussions;
- Potential scenarios for a CBAM and how (and where) stakeholders should engage in the legislative procedure;
- Options for a WTO-compliant CBAM;
- Practical steps that companies should take now and in the coming months during the German EU presidency.
