2019 PTAB Bar Association’s Thought Leader Summit

In conjunction with meetings of the PTAB Bar Association’s Board of Directors and committee leaders, approximately 100 members of the general PTAB Bar Association membership will join Association leadership and invited APJs for two advanced PTAB CLE sessions followed by a networking reception.

Partner Monica Grewal will moderate Session 1 with Chief Judge Boalick. This panel presentation will address expected guidance from the USPTO, recent case law, and trends in the practice. The panel will include APJs, and possible topics include claim construction, claim amendments, the revised Trial Practice Guide, post-SAS remands, Section 101 guidelines, multiple proceedings in light of Sections 314(a), 315(d) and 325(d), ex parte reexams and reissue in parallel with PTAB trials, precedential decisions and ex parte appeals from examination.

Partner Joshua Stern will moderate a table for Session 2. This session will feature moderated interactive table discussions on some advanced topics in PTAB practice. This panel will offer the opportunity for meaningful small group discussions with APJs. Possible topics include real parties in interest and privies, public availability of prior art, motions to amend, update to Trial Practice Guide (Remand Practice, Protective Orders and Discovery), multiple petitions and discretionary denials, and effect of claim construction move from Broadest Reasonable Interpretation.
