The IP Decisions From the Supreme Court This Term: What You Need to Know

Counsel Kelli Powell joins some of Boston’s other top IP litigators for a discussion of the US Supreme Court's 2019 IP decisions. The Court has either decided or is scheduled to decide issues related to patents, copyrights, trademarks and licensing. The panelists will discuss these decisions and related issues, including:

  • Whether confidential sales may qualify as prior art after adoption of the America Invents Act (AIA)
  • Whether the government is a “person” who may petition to institute review proceedings of an issued patent under the AIA
  • The date on which copyright registration is effective for purposes of bringing an infringement action
  • What costs are recoverable by a prevailing party under the Copyright Act
  • Clarification of the treatment of trademarks as “intellectual property” under the Bankruptcy Code
