Assessing the “but-for” world is an essential component of reverse payment litigation but to date has received less attention than other issues, such as what constitutes a payment. The panel will provide an update on reverse payment litigation with a focus on “but-for” world considerations. The panel will also discuss new research on Paragraph IV litigation outcomes as well as the use of stock price event studies to assess the but-for world.
