The Commodity Futures Trading Commission has issued its much anticipated final guidance on the cross-border application of the swaps provisions of the Commodity Exchange Act, as added by Title VII of the Dodd-Frank Act (“Final Guidance”). The Final Guidance will be of interest to all persons who conduct cross-border swaps transactions, and will have far-reaching effects for many.
