The year 2022 was a historic year for the Commodity Futures Trading Commission (“CFTC” or the “Commission”). The past year saw new developments in digital asset markets, and in the event contract and retail commodity/precious metals spaces. Record-breaking penalties and fines were issued from an aggressive enforcement effort, with novel theories established in cases that addressed issues of first impression.
