We are delighted to announce the publication of The Guide to IP Arbitration (First Edition, Global Arbitration Review, 2021).
The book is edited by John V.H. Pierce, a partner and head of the International Arbitration Practice in the New York Office of Wilmer Cutler Pickering Hale and Dorr LLP, and Pierre-Yves Gunter, a partner and co-head of the arbitration practice at Bär & Karrer in Geneva, Switzerland. Mr. Pierce and Mr. Gunter organized and structured the contents of the Guide, selected the contributors, edited the various chapters, and wrote the Introduction.
The Guide to IP Arbitration brings together leading practitioners from a wide range of jurisdictions who have expertise and experience both in international arbitration and in IP-related disputes. The objective of the book is to explore and elucidate the key features of international IP arbitration from a truly global perspective, and, in doing so, to become an essential desktop reference for counsel, arbitrators and corporate stakeholders involved in international IP disputes.
The Guide to IP Arbitration is divided into five parts, each covering a set of considerations to be taken into account at different points in the arbitral process. The chapters begin with an analysis of arbitration versus litigation as a forum for resolving international IP disputes; they then address the various strategic issues that arise in international IP arbitration, with a particular focus on certain key types of IP disputes; and they conclude with a discussion of remedies in international IP arbitration. This approach allows for a comprehensive journey through the arbitration process, touching on the most important procedural and substantive issues that may arise in IP-related disputes.
