Keith L. Slenkovich

Keith Slenkovich represents companies in intellectual property disputes and complex commercial litigation. As first chair trial counsel, Mr. Slenkovich has tried dozens of cases in venues throughout the country, earning a reputation for his ability to win the most difficult cases, including his perfect win record for intellectual property trials. In addition to state and federal jury trials, Mr. Slenkovich's practice includes substantial experience representing companies in Section 337 cases before the US International Trade Commission, as well as before international tribunals such as the Hong Kong International Arbitration Centre. 

In addition to his trial practice, Mr. Slenkovich has successfully argued appeals to state and regional circuit courts throughout the nation, and has substantial experience handling post-grant proceedings before the PTAB. 

Mr. Slenkovich is admitted to practice in the State of California and before the United States Supreme Court, the United States Court of Appeals for the Federal Circuit, the United States Court of Appeals for the Ninth Circuit, the Supreme Court of California, the United States District Court for the Eastern District of Texas and all United States District Courts of California.

Mr. Slenkovich has been a frequent lecturer in patent and other intellectual property law courses at institutions such as the University of California, Berkeley (Boalt Hall) and Santa Clara University.

Community Involvement

Mr. Slenkovich is currently a Director for the Lawyers Committee for Civil Rights. Mr. Slenkovich recently served Board Chairman and Director of Silicon Valley Habitat for Humanity.

Professional Activities

Mr. Slenkovich is a member of the American Bar Association (Intellectual Property Section), the International Trade Commission Trial Lawyers Association and the Intellectual Property Owners Association, Standards Setting Committee.

Experience

  • In recent years, Mr. Slenkovich's work has included the following matters:

    • Lead trial counsel for plaintiff in three-patent case involving semiconductor bus arbitration and energy conservation technology. Obtained judgment as a matter of law of validity and infringement of principal patent, leaving only damages to be tried. The next court day after achieving JMOL of liability, obtained highly favorable settlement for client. 
    • Lead trial counsel for respondent in International Trade Commission investigation related to semiconductor bus termination technology. Obtained trial victory of no violation for client on three alternative grounds: invalidity, non-infringement and lack of domestic industry. Trial victory upheld by full Commission.
    • Represented plaintiff in patent case arising out of solar cell and semiconductor manufacturing equipment technology. As lead trial counsel, obtained first verdict of validity, infringement and permanent injunction following the seminal KSR v. Teleflex decision. Successful verdict, which was upheld on appeal, prevented defendant from bringing to market product line which had threatened $1 billion annual market.
    • Represented respondent as lead trial counsel before International Trade Commission in action seeking to bar importation of client's semiconductor chips on the basis of alleged process patent infringement. Obtained determination from ALJ and full commission that patent was invalid, resulting in finding of no violation.
    • Represented defendant in trade secrets case involving competing semiconductor companies. As lead trial counsel, successfully defended case against threatened product injunction, achieving dismissal of all claims.
    • Represented plaintiff as lead trial counsel in declaratory judgment action challenging the enforceability of patents related to internet marketing technology on basis of inequitable conduct. Obtained uncompensated, worldwide license to all patents at issue.
    • Represented plaintiff in trade secrets case involving semiconductor process technology. As lead trial counsel, obtained permanent injunction barring use of proprietary technology and former employee contact with competitor.
    • Represented respondent before International Trade Commission in action seeking exclusion order barring importation of digital cameras on the basis of alleged patent infringement. Achieved favorable settlement following ITC hearing and Office of Unfair Import Investigations findings that all patents were invalid and not infringed.
    • Lead counsel in case alleging trade libel and trademark infringement case arising out of mobile application advertising campaign. Obtained early settlement and cessation of campaign. 
    • Represented plaintiff in claims arising out pharmaceutical plant's high purity gas delivery system. As lead trial counsel, obtained $26 million trial victory for client.

  • Named to the Daily Journal's 2013 and 2015 lists of "Top Intellectual Property Lawyers" in California for his leadership and innovation
  • Received the 2013 Robert G. Sproul, Jr. Award from the Lawyers Committee for Civil Rights for providing outstanding legal representation to under-represented communities
