Jason H. Liss
Special Counsel
Jason Liss' practice focuses on intellectual property matters at the agency, trial and appellate levels. He has represented clients in patent disputes involving a variety of technologies, including semiconductors, computer networking protocols and components, wireless and cellular communication standards, navigation devices, DNA testing technology, loudspeaker design and pharmaceuticals. His practice encompasses all facets of litigation, including pre-suit investigations, pleadings, discovery, alternative dispute resolution, trial and appeal. He has experience with district court trials before both bench and jury, Federal Circuit appeals, International Trade Commission investigations, and Patent Trial and Appeal Board inter partes review proceedings.
Mr. Liss also maintains an active pro bono practice, including a lead role in the representation of students challenging the disciplinary practices of the public elementary, middle and high schools of Mobile, Alabama, which yielded a settlement that provided for far-reaching changes to the school district's policies and procedures and quickly resulted in concrete, measurable improvements. In addition, he successfully appealed a denial of veterans' benefits and secured a favorable settlement for a disabled business owner in state court litigation
Mr. Liss is admitted to practice in the Commonwealth of Massachusetts and before the United States District Court for the District of Massachusetts, the United States Court of Appeals for the Federal Circuit and First Circuit, and the United States Supreme Court.
Community Involvement
Mr. Liss is an active member of the Cambridge community. He serves on the Board of Directors of the Margaret Fuller Neighborhood House, which works to strengthen and empower youth, families and residents of the Port/Area IV community, as well as on the City of Cambridge Broadband Task Force, which examines options to increase competition, reduce pricing, and improve service for both residents and businesses.

Mr. Liss is a member of the Boston Bar Association and American Bar Association. At WilmerHale, he serves on the Technology Advisory Committee and the Pro Bono and Community Service Committee.

Recent Highlights
- Represented computer and mobile device manufacturer in well-publicized large-scale patent infringement litigation before the International Trade Commission and multiple district courts
- Represented auto manufacturer in successful jury trial defense of patent infringement claims, including invalidation of asserted patents
- On behalf of manufacturer of computer networking components, obtained injunction against competitor in patent infringement case following jury trial, and defended infringement judgment and injunction against challenge on appeal
- Coordinated efforts of large joint defense group and represented computer networking components manufacturer in litigation relating to Bluetooth and Wi-Fi technologies spanning multiple district court cases, Federal Circuit appeals and successful Supreme Court petitions, as well as a successful motion to dismiss the nominal patent owner
- On behalf of provider of printing and business services, obtained dismissal, affirmed by Fifth Circuit, of multidistrict consumer class action relating to online marketing practices
- On behalf of VoIP service provider, obtained favorable settlement in litigation involving multiple successful motions to dismiss patent infringement complaints and multiple inter partes review proceedings
- Represented computer networking components manufacturer in district court litigation and multiple inter partes review proceedings relating to VoIP technology
- Represents medical device manufacturer in district court litigation relating to DNA testing technology
- Represents pharmaceutical company against multiple challenges from generic suppliers in bench trial and Federal Circuit appeal
- Represents computer and mobile device manufacturer in district court patent litigation relating to loudspeaker design
Pro Bono
- Served in a lead role in the representation by WilmerHale and the Southern Poverty Law Center of students challenging the disciplinary practices of the public elementary, middle and high schools of Mobile, Alabama, which yielded a settlement that provided for far-reaching changes to the school district's policies and procedures and quickly resulted in concrete, measurable improvements
- On behalf of a disabled small-business owner of limited means, obtained a favorable settlement in litigation of a long-standing dispute with a co-owner
- Represented a veteran in the successful appeal of a denial of benefits
