Ms. Ovington is a skilled litigator representing clients in life sciences, technology, retail, automotive, nonprofit, and other industries in matters concerning alleged monopolization, restraints of trade, price fixing, bid rigging, price discrimination, and other forms of anticompetitive and exclusionary conduct.  

Ms. Ovington’s practice encompasses all aspects of  litigation, including pre-suit investigations, pleadings, fact and expert discovery, depositions, motion practice, settlement, trial preparation, trial and appeals.  She also counsels clients on antitrust risk and compliance.  

Ms. Ovington also represents companies, including smaller and emerging businesses, hindered by anticompetitive or exclusionary conduct. On behalf of these firms, Ms. Ovington has successfully pursued claims of monopolization and attempted monopolization, restraints of trade, price discrimination, unfair competition and tortious interference.  

Ms. Ovington represents clients in at the intersection of antitrust and intellectual property law, and has successfully litigated trade secret and intellectual property matters in courts throughout the country.

    • Secured favorable settlement for client in the energy trading space on the back of antitrust counterclaims premised on rival’s abuse of sham litigation to stymy emerging competitors
    • Brought antitrust counterclaims against rival aluminum company, securing favorable settlement of all claims including claims for trade secret misappropriation
    • Represents global food corporation in a class action alleging anticompetitive information exchange among meat processors
    • Successfully moved to dismiss “product hopping” claims brought by state attorneys general against a major pharmaceutical company
    • Defeated bid rigging claims asserted against medical imaging company, resulting in settlement involving no payment to plaintiff
    • Secured favorable settlement for a major company in the oil industry accused of monopolization based on allegations of Walker Process fraud
