Ewart, Nicole

Nicole Ewart focuses her practice on complex litigation and regulatory matters, with a particular focus on cybersecurity, privacy and communications issues. Her experience includes counseling clients on Gramm-Leach-Bliley Act compliance, E-Sign, and the Computer Fraud and Abuse Act. She also advises clients on mobile phone application and website privacy policy requirements. Additionally, Ms. Ewart assists clients with responding to FTC compliance orders, notices of proposed rule-making and consumer protection issues.

Prior to joining the firm, Ms. Ewart was a law clerk to the Honorable Christopher C. Conner of the United States District Court for the Middle District of Pennsylvania. During law school, she also served as a judicial extern to the Honorable James Bradberry of the United States District Court for the Eastern District of Virginia and was a graduate research fellow at the William & Mary School of Law. 

Representative Matters

  • Counseled company on CAN-SPAM requirements for commercial electronic mail
  • Advised major hotel chain on mobile phone application privacy requirements.
  • Drafted legal memorandum in support of client comments to the FTC's proposed amendments of trade regulation rule.
  • Counseled client on implications of proposed amendment to the Computer Fraud and Abuse Act.
  • Advised banks and financial institutions on Gramm Leach Bliley Act financial privacy and E-Sign requirements.
  • Counseled investment firm on federal and state monitoring requirements and privacy issues triggered by the firm's risk management tool.
  • Assisted financial institutions with internal and governmental investigations and subpoena responses.
