WilmerHale Partner Paul Architzel and Special Counsel Gail Bernstein presented a Thomson Reuters webinar on August 21, 2013, addressing the recent provisions made by the Commodity Futures Trading Commission (CFTC) to the Commodity Exchange Act affecting the cross-border application of Dodd-Frank swaps. The provision, referred to as the "Final Guidance," which came into effect on July 26, 2013, is applicable to persons conducting cross-border swaps transactions and will have many implications for the broker-dealer industry in the future.
Architzel and Bernstein discussed many aspects of the Final Guidance, including the interpretation of the "US Person," swap dealer regulation, foreign branches, and regulatory requirements, among others.
In addition to presenting the webinar, Architzel, Bernstein and Associate Mahlet Ayalew authored an article entitled, "CFTC Finalizes Guidance on Cross-Border Application of Dodd-Frank Swap Provisions," which was published by Thomson Reuters on August 20, 2013, in Business Law Currents.
