We will focus on the importance of properly structuring and classifying the workforce. Specifically, we will discuss: (i) the new groundbreaking Massachusetts Triple Damages Law for wage and hour violations; (ii) the explosion of wage and hour litigation under the Fair Labor Standards Act in the the proper classification of employees as exempt or non-exempt and traps for the unwary in this area; and (iii) the current state of Independent Contractor Law, including a recent advisory from the Massachusetts Attorney General's office.
