Environmental diligence is a vital component of most real estate transactions. This session will review the fundamentals of environmental diligence ranging from engaging an environmental consultant to scoping out an environmental site assessment and managing any identified environmental risk, with a special focus on environmental insurance. Perspectives of the buyer, seller, landlord, tenant, lender and borrower will be considered. The discussion items also will touch on the ASTM 1527-13 standard governing Phase I environmental site assessments; vapor intrusion and indoor air issues; phase II investigations/subsurface testing, chapter 21E and release reporting; access agreements and licenses; and tools for allocating environmental risk.
