Experience

A few companies that we have recently helped navigate governmental waters include:

  • We have assisted A123 Systems on numerous strategic regulatory matters, including federal and regional regulatory issues involving the operation of grid-connected energy storage systems in the ancillary services market, as well as obtaining registration under the Toxic Substances Control Act for materials used in manufacturing
  • We advised American Superconductor in the drafting of proposed legislation to authorize the Department of Energy to provide funding to electric transmission projects under the Recovery Act, and assisted the company in the formation of project development affiliate to develop electric infrastructure projects (including the Tres Amigas Project)
  • We are advising one of the largest oil and gas companies in the world on international trade/World Trade Organization and competitiveness aspects of US and foreign climate change legislation, including in the context of the ongoing legislative debate about US cap-and-trade legislation the US Congress (Waxman-Markey, Kerry/Boxer) as well as certain aspects of the UNFCCC international climate change negotiations
  • We advised Cape Wind Associates, LLC on environmental permitting and policy issues associated with the development of the nation’s first proposed offshore wind energy generation facility
  • We were retained by a domestic ethanol producer and an ethanol producer trade association to advise them on legal and policy issues relating to several national and regional regulatory programs addressing the use of ethanol and ethanol-blended alternative fuels
  • We are advising a synthetic fuel manufacturer in connection with issues relating to the development and production of alternative fuels under various domestic climate change related programs, including the Cellulosic Fuel Producer Credit, EPA’s renewable fuels standard and regulatory requirements for alternative fuels, and related administrative and legislative developments
  • We represent a European Union-based trade association with respect to its US, EU and worldwide policy, advocacy and legal strategy in the UNFCCC climate change negotiations, with a particular focus on technology transfer and intellectual property (IP) issues
  • We have advised several international manufacturers on emerging energy and environmental-related regulations in the European Union (such as RoHS, WEEE and REACH), China and South Korea
  • We are assisting Weaver's Cove Energy, LLC on environmental permitting and policy issues associated with the development of an on-shore LNG Marine Import Terminal
  • We represented INIMA USA in connection with securing regulatory approval for the construction of a wholesale water desalination plant in Massachusetts

On August 15, President Trump signed an Executive Order calling for streamlined federal review of major infrastructure projects. The Order builds on prior efforts to streamline infrastructure permitting by setting new goals for federal reviews of covered projects and establishing formal methods to hold agencies accountable for the efficiency of their reviews.
