State Biometric Privacy Law - February 27, 2023

The first two months of 2023 have seen biometric privacy law proposals emerge in at least 11 state legislatures across the country. If enacted into law, many of these bills — the majority of which borrow heavily from Illinois’s Biometric Information Privacy Act (BIPA) — would impose new requirements on companies’ collection and use of biometric information and potentially expose businesses to significant legal liability for mishandling biometric information (including substantial damages).
