FCPA prosecutions are increasing with the amount of disgorgement and fines escalating. The prosecution of individuals caught by the use of blue collar tactics is also on the increase. As a result, more FCPA cases are being tried. A recent jury verdict ended with the company being convicted, and the trials of those indicted in the largest FCPA sting case are underway. Other cases are awaiting trial. Business groups have called for reform, claiming that the Act makes it difficult for US companies to compete in a global world. The new UK Bribery Act has been called the “FCPA on steroids”, and Congress is considering amending the current FCPA statute. This program will explore these key trends and provide practical advice for companies, practitioners, and compliance officers.
