Assisted facilities nationwide in establishing programs and addressing compliance issues under The Emergency Planning and Community Right-to-Know Act and state analogs, including submissions of Forms R under the federal Toxic Chemical Release Inventory program; obligations to correct previous filings; refining and upgrading record keeping practices and compliance reporting systems; preparation for inspections; Toxic Release Inventory reduction strategies; and defense of enforcement actions.
Advised a wide variety of clients with respect to compliance with the Hazard Communication Standard issued by the Occupational Safety and Health Administration.
Participated in both the legislative development and administrative implementation of the Massachusetts Toxic Use Reduction Act on behalf of the Associated Industries of Massachusetts and the Chemical Manufacturers Association.
Advised clients with respect to confidentiality and trade secret protection under these regulatory programs.
Advised clients on regulatory proposals to expand the scope of Emergency Planning and Community Right-to-Know Act reporting.
