Regulatory and Government Affairs
When a government agency investigates or brings an enforcement action against a company, the quality of legal representation can make all the difference in the proceeding’s outcome. Our lawyers are highly experienced in counseling companies in investigative and civil proceedings brought by federal and state law enforcement agencies. We often resolve issues at the agency level, but also have a distinguished record of disputing agency actions in court.
On behalf of defense contractors and other clients, we conduct internal corporate investigations in a range of areas, including contract claims, export control, foreign payments, government program fraud, conflicts of interest and misappropriation of competitor proprietary information. For example, we represented the Boeing Company in an internal corporate investigation concerning the US Air Force KC-767 Tanker Program, including conflicts of interest.
We also provide representation in related inquiries and enforcement actions by:
- Inspectors General of the Department of Defense (DOD) and other agencies
- The Department of Justice (DOJ) and relevant US Attorneys
- The Securities and Exchange Commission
- Agency contractor responsibility offices
We represent companies in False Claims Act qui tam actions brought by relator plaintiffs, as well as actions commenced by the DOJ. Our lawyers have argued qui tam cases in the US Supreme Court and federal courts of appeals. With extensive experience in governmental positions, our lawyers work effectively with fraud enforcement offices at the DOJ, DOJ and agencies’ Inspectors General.
