With the addition of the former Deputy Chief of the FCC’s Enforcement Bureau to our legal team, we are particularly well equipped to navigate the difficult issues facing companies under investigation by the FCC and other agencies. The FCC has turned increasingly to investigations and adjudicatory proceedings to address alleged violations of the Communications Act, including, most notably, the provisions of the Telecommunications Act of 1996.
In some of our most prominent enforcement matters, we:
- Defended a Bell company against a claim for damages for violation of section 271 in providing nationwide directory assistance service
- Represented Bell companies in FCC investigations of alleged marketing and provision of InterLATA services before they obtained section 271 authorization
- Provided counsel to a major wireless operator in FCC and Department of Justice investigations of alleged “bid signaling” and collusion in the FCC’s PCS license auctions
- Defended a Bell company against claims of discriminatory and unreasonable pricing of special access services
- Advised a major bank lender in an FCC investigation and hearing on possible revocation of the licenses of a bankrupt paging carrier
- Defended a Bell company against a claim for damages for alleged violation of an interconnection agreement and section 251 regarding provisioning of interconnection
- Defended a Bell company against a claim for damages for alleged violation of an interconnection agreement with respect to conversion of special access lines to EELs
- Defended a large ILEC against claims seeking payment of reciprocal compensation for ISP-bound traffic
